Terms and Conditions of Use

These Terms and Conditions apply to all users of the Genie platform. Registration and use of the platform requires your full and unreserved acceptance of these terms.

Genie is a service operated and owned by HEALTH ZONE-E, UNIPESSOAL, LDA, headquartered at Rua do Cepo, n.º 53, 2415-366 Leiria, Portugal, registered under VAT Number (NIPC) PT516569929.

The acceptance of these Terms presupposes acceptance of our Privacy Policy. Health Zone-e reserves the right to modify these Terms at any time. Substantial changes will be communicated to users via email or in-platform notification.

1. The Genie Service

Genie is an Artificial Intelligence (AI) assisted development platform oriented towards existing software projects. The service allows analysis, editing, and real-time preview of code using third-party large language models (e.g., Anthropic Claude). Access is provided through different subscription plans (Free, Pro, and Enterprise) based on a credit system detailed on the platform.

The platform provides: AI-assisted code editing via a Zero-Destruction Sandbox; real-time preview environments (Fly.io containers); Pull Request automation; Rollback and Time Travel functionality; and multimodal chat (images, text files).

2. Minimum Age

To use Genie, users must be at least 16 years old at the time of registration, in accordance with the GDPR (General Data Protection Regulation) age of digital consent applicable in Portugal. Users under 18 who subscribe to paid plans must have parental or guardian consent.

3. Account Registration and Security

To register, users must provide accurate, complete, and truthful information. Registrations are personal and non-transferable. You are solely responsible for all activity that occurs under your account.

You must notify us immediately at hello@genie.dev upon becoming aware of any breach of security or unauthorised use of your account.

When connecting via OAuth (GitHub, GitLab, or Bitbucket), Genie requests read/write access to repositories strictly for the purposes of reading your codebase and creating pull requests on your behalf. Your code is never used to train models or shared with third parties beyond the subprocessors listed in our Privacy Policy.

4. Nature of AI — Disclaimer of Liability

The user expressly understands and agrees that:

• AI Makes Errors (Hallucinations): The AI models used by Genie are probabilistic systems. Code, suggestions, diffs, or corrections generated may be inaccurate, incomplete, inefficient, or contain security vulnerabilities.
• Obligation to Validate: The Zero-Destruction Sandbox ensures your code is not altered without your explicit approval. You are solely responsible for reviewing, testing, and validating all generated code before merging or deploying to production.
• No Warranties: Genie is provided on an “as is” and “as available” basis. Health Zone-e makes no warranties that the generated code will be error-free, fit for a particular purpose, or non-infringing on third-party rights.
• Limitation of Liability: In no event shall Health Zone-e, its directors, employees, or partners be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of code generated by Genie or from preview environment failures.

5. Rules of Use and Prohibited Activities

Genie applies strict limits to protect platform integrity (e.g., 5 MB file hard-limits, character limits in chat). Attempting to bypass these limits constitutes a breach of these Terms.

It is strictly forbidden to use Genie or its preview environments for:

• Cryptocurrency mining
• DDoS attacks or any form of network abuse
• Malware hosting or distribution
• Spamming or unsolicited communications
• Any illegal activity under Portuguese or applicable EU law
• Exploiting or harming minors in any way
• Impersonating Health Zone-e, its employees, or other users

Violations will result in immediate account termination without any right to a refund. Health Zone-e reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion.

6. Credits and Subscription Plans

Access to Genie features is governed by a credit system. Credits are consumed at different rates depending on the AI model used (Lite, Pro, Max) and preview usage.

• Free Plan: 5 credits/day on a “use it or lose it” basis — credits do not roll over to the following day.
• Pro Plan (€19/month or €15/month annual): 100 credits/month + 5 daily credits, access to all models and features including Pull Requests and Rollback AI.
• Enterprise: Pricing negotiated directly. Contact hello@genie.dev.
• Top-ups: Additional credits may be purchased at any time. Top-up purchases are non-refundable once the credits have been (even partially) used.

7. Payments, Billing and Right of Withdrawal

Payments are processed by Stripe. By subscribing to the Pro plan, you agree to automatic renewal at the end of each billing cycle unless cancelled beforehand. You may cancel at any time via your account settings.

Right of Withdrawal (EU Directive 2011/83/EU): As Genie is a digital service delivered immediately upon subscription, you expressly consent to the immediate delivery of the service and acknowledge that you waive your 14-day right of withdrawal once the service has been activated and credits have been made available. This is in accordance with Article 16(m) of EU Directive 2011/83/EU.

We do not issue refunds for partially unused subscription periods. Refunds are only issued in cases where a different amount than agreed was charged, or in cases of undue charges after a confirmed cancellation. For refund requests, contact hello@genie.dev.

8. Automatic Subscription Renewal

By accepting these Terms, you authorise the automatic renewal of your subscription and the charging of the applicable fee through the payment method on file. Subscriptions can be renewed monthly or annually depending on the selected option. You may cancel at any time before the next renewal date via your account settings.

9. Service Changes and Discontinuation

Health Zone-e reserves the right to modify, suspend, or discontinue any part of the Genie service at any time, with reasonable prior notice where possible. In the event of discontinuation of a paid plan, any unused prepaid credits or subscription time will be refunded on a pro-rata basis.

Health Zone-e does not guarantee continuous or uninterrupted access. The service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

10. Intellectual Property

Your Code: Health Zone-e claims no ownership over the original code you submit to the platform, nor over the code generated with AI assistance. Intellectual property rights of your project remain strictly yours.

The Platform: The infrastructure, design, “Genie” brand, and software architecture belong exclusively to Health Zone-e. Any full or partial reproduction, adaptation, or commercial use of the platform or its components is strictly prohibited without prior written consent.

11. Account Cancellation and Data Deletion

You may cancel your account at any time via your account settings or by contacting hello@genie.dev. Upon cancellation:

• Your project ZIPs and uploaded images stored in Cloudflare R2 will be deleted within 30 days.
• Your conversation history stored in our database will be deleted within 30 days.
• Your authentication data held by Supabase will be removed.
• Stripe retains billing records as required by applicable financial law.

Deleting the app or revoking OAuth access does not automatically cancel an active subscription. Subscription cancellation must be performed explicitly in your account settings.

12. Confidentiality

You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. You must not use a username that infringes third-party rights or that is offensive, vulgar, or obscene.

13. System Integrity

The use of any device, software, or resource that may interfere with the operations of Genie is not permitted. This includes but is not limited to: robots, scrapers, or automated tools not authorised by Health Zone-e; introduction of malicious code; denial-of-service attacks; and any attempt to gain unauthorised access to our systems.

14. Governing Law and Jurisdiction

These Terms are governed by Portuguese Law. For the resolution of any dispute arising from these Terms, the parties submit to the exclusive jurisdiction of the District Court of Leiria, Portugal, expressly waiving any other.
